This error might be avoided by using an optional argument of \section (as you said). But, now I strongly recommend to use \chapter for chapter-heading. Of course, class file might be replaced with jbook.cls or so. And \@makechapterhead might be modified (e.g. change \unhbox\z@\nobreak to \unhbox\z@\\).
